Terms and Conditions PRESENTATION POWER Schneider
1. APPLICABILITY
These General Terms and Conditions (hereinafter referred to as GTC) apply to all agreements between PRESENTATION POWER Schneider (hereinafter referred to as PP) and customers who use the services of PP. The General Terms and Conditions, along with any orders placed or the customer's registration constitute the complete contract. Deviating agreements are only binding for PP if they have been drafted in writing and signed by both parties.
2. CONCLUSION OF CONTRACT
The contract between PP and the customer comes about as a result of the customer and / or other participants registering for a training course. The applicant is liable for the fulfillment of the obligations deriving from this application.
3. SERVICES OF PP
PP organizes individual trainings (seminars, courses, trainings, individual coaching, group coaching sessions and workshops, etc.) with content that has been previously agreed upon with the customer. The scope of the contractual services results from the service description in the offer or from the information in the contract between PP and the customer.
The training is carried out by PP according to the agreed upon schedule and at the agreed place. PP aims at the greatest possible development of the customer and / or the participants registered by him in relation to the defined topic.
4. CONDITIONS / TRAINING SUCCESS
In the case of physical restrictions, each participant is obligated to cancel the respective exercise on his / her own behalf.
5. IMPLEMENTATION OF TRAINING
PP implements training using the agreed upon content within the timeframe and at the place agreed upon with the customer. In the event the training fails for reasons for which PP is responsible (e.g. illness), the customer will receive a suitable replacement date. Further claims on PP do not exist.
6. INFRASTRUCTURE OF ROOMS
If the place of training is decided by the customer, the customer is responsible for the provision of necessary aids. PP will communicate the exact needs beforehand.
7. CONFIDENTIALITY
Recorded image and sound material is used only for the purpose of joint analysis with the customer or for internal training purposes. This picture and sound material is deleted at the latest after receipt of payment.
Unless otherwise agreed, PP may use the customer's logo as a reference on the PP website.
8. INTELLECTUAL PROPERTY
The copyright to the training content, the ideas and the exercises developed by PP remain with PP.
9. PRICES AND PAYMENT TERMS
The customer undertakes to pay the services of PP on time.
10. CANCELLATION OR POSTPONEMENT BY THE CUSTOMER
If customer participation or performance of a service must be canceled or postponed, PP may demand a cancellation fee. This depends on the time of cancellation and is calculated as follows:
- up to 21 working days before the start of the service (e.g. training), cancellation / postponement is possible without cost,
- 20-16 working days before the start of the service (e.g. training), 25% of the agreed price will be payable in case of cancellation
- 15-11 working days before the start of the service (e.g. training) 50% of the agreed price will be payable in case of cancellation.
- from the 10th working day before the start of the service (for example training) or in case of no-show, the full agreed price is due in the event of cancellation.
Postponement from 20 working days before the start of the service (e.g. training) is only possible if the replacement date is within 1 month of the original date. If it is not possible to find a replacement date that is possible for both parties within this period of time, the above-mentioned provision with the cancellation fee automatically becomes effective upon cancellation. For short-term shifts from 10 working days before the start of the service (e.g. training) PP may charge an additional default fee of 25 percent of the agreed total price to the account of the customer.
In the case of public training / courses to which participants of various companies, institutions etc. register directly with PP, other provisions apply. These provisions will be notified to the customer by email.
11. WARRANTY
PP is committed to adapting the preparation and execution of the training to the specific circumstances and individual requirements of the participants, and to providing the training content in a fashion appropriate to participants.
12. LIABILITY / INSURANCE
PP can not assume any liability for accidents that occur during training and damage, loss or theft of items brought to the training or the premises, including material. During the training and transit to and from the training courses there is at no time insurance protection by PP, their company owner or their coworker. PP, its owner and their employees assume no liability for health and other consequential damages. Insurance coverage is the responsibility of the participant or his company.
13. LAW AND JURISDICTION
The ordinary courts at the registered office of PP or at the place of the collection agency determined by PP are exclusively responsible regarding disputes in connection with this contractual relationship.
14. FINAL CLAUSE
Should individual provisions of these Terms and Conditions be or become ineffective, this shall not affect the remaining provisions. The ineffective provision shall be replaced by a provision that comes as close as possible to the invalid provision. The ineffectiveness of individual provisions of the training contract does not result in the invalidity of the entire training contract. If PP waives the enforcement of these terms and conditions in individual cases, this does not mean that these terms and conditions are changed.
